These Terms and Conditions (“T&C”) apply to the use of this website and to all orders placed via the online shop of Star Tender AG Switzerland (“we”, “us”).

Our offer is directed at customers residing in Switzerland, the Principality of Liechtenstein, and member states of the European Union. Deliveries are made to these countries unless otherwise stated in the online shop.

By accessing this website or placing an order, you agree to these T&C in their currently valid version.

Use of the Website

The online shop may only be used by legally competent persons.

It is prohibited to use the website or its content for unlawful, abusive, or technical interference purposes (e.g. malware, automated access, scraping).

We reserve the right to refuse or restrict orders or access to the website for justified reasons, insofar as legally permitted.

Information and Offers

All information regarding products, prices, availability, delivery times, and technical details is provided for informational purposes only and does not constitute a binding offer.

Product images may differ from the actual product (e.g. due to screen settings). Errors and changes are reserved.

Prices

All prices are final prices in the currency displayed in the online shop.

🇨🇭 Switzerland
If Star Tender AG is not subject to VAT, no VAT will be charged or shown.

🇪🇺 European Union
For deliveries to EU member states, the applicable statutory tax regulations apply.

Shipping costs are shown separately during the checkout process.

Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.

By submitting an order, you make a binding offer to conclude a purchase contract.
An automatically generated order confirmation merely confirms receipt of the order and does not constitute acceptance.

The contract is concluded once we confirm shipment or dispatch the goods.

Customer Information and User Account

You are obliged to provide correct, complete, and up-to-date information when placing an order.

If a user account is offered, access credentials must be kept confidential. All actions carried out via the user account are attributed to you unless misuse is demonstrably proven.

Payment Methods and Default

The payment methods available in the online shop can be selected during the checkout process.

Payment is deemed completed only once we have full access to the amount due.

In the event of late payment, we reserve the right to charge default interest and reasonable reminder fees within the legally permissible scope.

Retention of Title

The goods remain the property of Star Tender AG Switzerland until full payment has been received.

Delivery and Shipping

Delivery is made to the delivery address provided during the ordering process.

Delivery times are non-binding estimates. Delays do not automatically entitle the customer to compensation.

Partial deliveries are permitted provided they are reasonable for the customer.

🇪🇺 EU Notice on Import Duties
For deliveries outside Switzerland, customs duties, import charges, or other fees may apply. These are borne by the recipient unless the shipment is explicitly declared as duty-paid (DDP).

Transfer of Risk

Risk and benefit pass to the customer upon handover of the goods to the customer or to a person authorized by the customer to receive them.

Inspection, Defects, and Warranty

The customer must inspect the goods immediately upon receipt.

Obvious defects or incorrect deliveries must be reported in writing to ht@star-tender.com within 3 business days of receipt.
Hidden defects must be reported immediately upon discovery.

In the event of justified defects, we may, at our discretion, provide a replacement, repair, or refund of the purchase price. Further claims exist only to the extent required by mandatory law.

Right of Withdrawal (EU Customers)

🇨🇭 Switzerland & Principality of Liechtenstein

There is no statutory right of withdrawal for customers residing in Switzerland or the Principality of Liechtenstein.

Orders are binding. Returns or refunds are granted exclusively as part of a voluntary goodwill policy if explicitly offered in the online shop.

Mandatory statutory rights, in particular warranty rights under Swiss Code of Obligations, remain unaffected.

🇪🇺 European Union

Customers residing in an EU member state have a statutory right of withdrawal of 14 days in accordance with EU consumer law.

The full withdrawal policy including the model withdrawal form forms an integral part of these T&C.

Liability

We are fully liable for damages resulting from intent or gross negligence as well as for personal injury.

For slight negligence, we are liable only in the event of a breach of essential contractual obligations and limited to foreseeable damages.

Liability for indirect damages, consequential damages, and loss of profit is excluded to the extent permitted by law.

Data Protection

The processing of personal data is carried out in accordance with our Privacy Policy, available on the website.

Governing Law and Jurisdiction

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

🇪🇺 For consumers residing in the EU, mandatory consumer protection provisions of their country of residence remain unaffected.

The place of jurisdiction is Schaffhausen, unless mandatory statutory jurisdictions apply.

Severability Clause

Should any provision of these T&C be or become invalid, the validity of the remaining provisions shall remain unaffected.
